Tidy Bear Cleaning, LLC may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

8. Booking Confirmation
Booking online does not guarantee you a spot for that date and/or time, you will be contacted by email or phone with confirmation.

9. Right to Refuse Service
Due to safety concerns, inappropriate or unpleasant circumstances, the presence of weapons on the premises, extreme clutter, and disconnected utilities, we reserve the right to refuse service and/or discontinue it.

10. Cleaning Day Preparation
For us to be able to provide the highest quality cleaning possible, we would just ask you to do a couple things to prepare for our arrival:
a. Please put away anything that would inhibit us from cleaning floors, such as loose papers, clothes, dog toys, children’s toys, etc.
b. Please make sure all dishes are put away so that we can thoroughly clean your kitchen.
c. Please put anything of a sensitive nature away.
Your cleaning fee is calculated based on the providers devoting all their time to cleaning. If you would like the providers to perform these tasks for you, please contact the office in advance so that your cleaning cost can be modified to account for the additional time.

11. Pets
Tidy Bear Cleaning, LLC will gladly work around pets. However, we retain the right to withdraw service providers from your house if your pet becomes agitated or poses a safety risk.
Providers are instructed not to enter a home if they deem an animal to be a threat; nonetheless, pets may behave differently when there is no family member there. Our cancellation policy shall apply if the withdrawal of our cleaning company is a result of aggressive pets.

12. Service Fees
Tidy Bear Cleaning, LLC reserves the right to adjust quotes from the phone or online based on the actual state of the home. We will call to notify you if the job will take longer than expected with the adjusted fee. If Tidy Bear Cleaning, LLC cannot reach you, the cleaning provider will have to leave and you will be charged the cancellation fee of 75% of your appointment cost.

In order to provide our service to the customer’s expectations, we retain the right to reevaluate our charges at any time. If the cleaning time varies significantly, Tidy Bear Cleaning, LLC will get in touch with the client to discuss price or service adjustments
​
13. Rate Increase
Clients may or may not be given advance notice of any price increases. Annually, the customer’s rate will increase by no more than 33% of the client’s current rate. Tidy Bear Cleaning, LLC reserves the right to raise prices at any time.

14. Subscription Service Discount
Recurring discounts start AFTER the first cleaning service, if you skip cleanings so that your cleaning’s frequency is lower than what you were set up for, your price will be increased to the pricing level for the lower frequency.

15. Refund Policy
We do not offer refunds since we have established our business on giving our customers the highest quality service possible. However, we are human, and things will from time to time get missed, should this happen, email or call us within 24 hours and we will correct the error at no charge.

16. Lockouts
The client must let Tidy Bear Cleaning, LLC cleaning providers into the service location on the day of the service. If the team is locked out of the client’s home, every effort will be made to contact the client to arrange for entry. If no contact is made within 30 minutes of the cleaning team’s arrival, the scheduled cleaning will be skipped and you will be charged a cancellation fee of 75% of the appointment cost will be charged to your credit card on file. This fee is required to compensate the providers for unexpected lost revenue and time travel.

17. Home Alarm Systems
If your home has a security system, please confirm that it is in the off position or call our office for the code and instructions on how to operate it. Please let us know if the code changes so that you do not incur a lockout fee. Tidy Bear Cleaning, LLC will not be liable for any false alarm charges due to code changes not brought to their attention before servicing the home.

18. Rescheduling and Cancellations
Due to the fact that we reserve a time specifically for you, we require a minimum of 48-hour notice if you need to modify or cancel your appointment. Within less than 48 hours of the scheduled appointment; there will be a $50.00 charge for rescheduling and a $100.00 fee for cancellation. If you cancel your appointment in less than 24 hours, or we cannot gain access into your home, you will be charged 75% of your appointment cost. All cancellations must be made through our office.

19. Quality Control
Please expect random quality checks to happen on your home by a quality control manager to make sure you are receiving consistently quality service. All quality checks take place during the final phase of cleaning.

20. Our Guarantee
Report any concerns to our office by calling/texting (817) 393-9535 and/or emailing contact@tidybearcleaning.us.com within 24 hours after the service. We will thankfully return and re-clean the areas of concern at no cost to you.

20a. Post – Guarantee Re-Booking Policy
Any additional cleaning requested or required after the expiration of the twenty-four (24)-hour satisfaction guarantee period will be subject to a new booking and a new booking charge at the applicable service rate. This applies regardless of the reason for the additional cleaning.
Furthermore, if the condition of the premises at the time of the original service necessitates a different or elevated level of service upon re-visit — for example, a standard clean followed by a subsequent deep clean due to the initial condition of the home — such re-visit shall constitute a separate and independent service engagement requiring a new booking and separate payment at the rate applicable to the service type required.
The Client acknowledges and agrees that the twenty-four (24)-hour guarantee applies exclusively to re-cleaning of missed or inadequately cleaned areas under the original scope of service, and does not entitle the Client to a different category of service at no additional charge.

21. Utilization of Owner’s Vacuum
If you request that we use your vacuum, we will not assume or accept responsibility for any damage that may occur. Since we are not responsible for the vacuum’s upkeep, we will not pay for any necessary repairs. This is vital because if the vacuum is broken when we arrive to clean your home, we will be unable to vacuum your carpets and hard floor surfaces.

22. Utilization of Owner’s Cleaning Supplies
If you request that we use your own cleaning supplies, please remember that we are not liable for any harm caused by those items. When this request is made, please have the cleaning chemicals and materials readily available so that we can complete our cleaning service as efficiently as possible.

23. Things Outside Our Scope of Work
Our professional housecleaning services are designed to keep your home comfortable and clean. We customize services to accommodate your preferences, so you never have to worry about paying for a service you don not need or want. However, the following are what our providers do not do:

Pick up clutter

Clean carpets

Mold: (Some amount of pink/orange mildew, or even darker mold, is common in some homes. Don't worry- the cleaners can clean small amounts of mold. Large amounts of mold in shower areas, on walls, etc. can affect air quality and pose a health safety issue. The cleaners cannot clean rooms that are heavily affected by mold, or in homes with heavy mold infestations.)

Weight: (We have a 30 lb. weight limit for safety and insurance reasons. Moving smaller items like dining table chairs, small ottomans, etc. to clean under is perfectly ok. If you would like any heavier furniture or appliances cleaned under, you are welcome to move it and the cleaners will be happy to clean under it upon request.)

Heights: (There is a limit to a 2 foot or shorter step stool. Safety is of the utmost importance to us. Please keep in mind that in most cases, the tops of standard kitchen cupboards is approximately the maximum height limit. Some lighting fixtures may also be out of reach.)

24. Technology
You will receive automated emails and texts prior to service. You may respond to the email: contact@tidybearcleaning.us.com, however the automated text messages are only one way. You do have the option to opt out of these notifications in your customer portal at tidybearcleaning.us.com or by letting us know. Tidy Bear Cleaning, LLC can be reached through the office phone number (817) 393-9535 and is able accept both calls and texts. Our cleaning providers may or may not clock in and out from our scheduling app on their phones and GPS coordinates are registered at time of input. This is to make sure they have arrived and left safely.

25. Payments
Payments for cleanings will be billed to the card on file or due upon receipt by check mailed to the office. Cleaners cannot accept payments for cleanings.
Our cleaning providers do not handle any form of cash or check payment. Tidy Bear Cleaning, LLC prefers a credit or debit card on file to eliminate the hassle of sending a check for each cleaning. If you would like to pay with a check, an invoice will be sent to you via email, which is due upon receipt. Mail a check to be received within seven (7) days of the cleaning. Note that lack of payment of previous cleanings means we will be unable to service your home until all bills are paid. If a history of late payment has been established, payment prior to cleaning will be required. A credit card is required on file as a back-up form of payment. Tipping the cleaning providers is never required but always appreciated. Thank you in advance if you choose to do so. You may add a tip to your card payment, a link can be sent to you via text or email or you may give the cash or check tip directly to the cleaner.

26. Work Estimates
When you provide us with the requested information for your home or enter the information on our website, we may or may not provide an estimate based on homes that are similar in size and reported condition. If our cleaners arrive and the home will require more time than estimated due to condition or not being picked up, we will communicate this to you before we go over the estimated cost for approval or denial. We will reach out by phone call and text message, if necessary to ensure quick communication. Though we do our best to estimate as accurately as possible, everyone’s home is different, and two similarly sized homes can take drastically different amounts of time depending on how the owner lives and the specifics of the home’s finishes and fixtures.

27. Working in the Home
The cleaning providers need to be able to work without distractions. Every effort is made for the cleaners to work safely, but we cannot assume liability for the safety of others while cleaning your home. This includes children and pets. In the event the cleaners are not able to work without distractions that affect their ability to work at their normal speed, Tidy Bear Cleaning, LLC reserves the right to charge for their extra time spent in the client’s home. If for any reason a cleaning provider of Tidy Bear Cleaning, LLC feels that their personal safety is in danger enough to leave the job site due to actions by the client, client’s guests, and/or animals, the client will be liable for the full cost of the service.

28. Biohazard
Our cleaning providers’ safety and health is of the utmost importance to us, so we ask you to let us know if there are any potential biohazard situations. These can include mold, rodent or bug infestations of any kind, or human or pet urination or feces. If a biohazard situation is evident, our providers will not be able to service your home and you will be charged the full rate of cleaning. Follow-up service cannot be performed until documentation is presented showing the situation has been resolved.

29. Safety
Our number one concern is for the safety of our clients and our cleaning providers. We are insured and bonded and cannot perform any cleaning higher than a two foot step stool. Any heavy or large furniture must be moved away from the walls in order to clean behind them. Our cleaning providers will not move furniture to prevent damage and to remain safe. Cleaning under beds is not performed unless requested.

30. Arrival Window
It is very difficult to commit to an exact arrival time because of our ever-changing schedule and the fact that we do not finish cleaning each home at an exact time. We service homes between the hours of 9:00 AM and 5:00 PM. and will strive to be at your home within a two-hour window of the estimated time given to you.

31. Entry to Your Home
We offer three (3) entry options to choose from:
a. The client may opt to be home to allow access to their home on the day of the service. Please prepare for your cleaner to arrive. If no one is home or our cleaners are turned away for any reason, a cancellation fee of 75% of the appointment cost will be charged to your credit card on file.
b. The client provides a key, garage door opener or code to gain access to the home. Keys will be placed in a secured for safekeeping by Tidy Bear Cleaning, LLC. The cleaner or team will be issued a key the day of your scheduled service to gain access to the home. The key will be signed out by the cleaner or team and signed in after each scheduled service and placed back in the safe. The keys are not marked with any of your personal information in case they are lost. In the event the code given is not correct and cleaners cannot gain access to the home, the client is responsible for the lockout and a cancellation fee of 75% of the appointment cost will be charged to your credit card on file.
c. The client can purchase a lock box to place a key inside and provide Tidy Bear Cleaning, LLC with the pass code. In the event if for any reason the key is not in the lock box or the code does not work when the cleaners arrive to clean the home; the client is responsible for the lock out and a cancellation fee of 75% of the appointment cost will be charged to your credit card on file.
NOTE: In the event the client chooses to leave a door unlocked, or place a key under a mat or any other unsecured place for the cleaners to gain entry into the home, Tidy Bear Cleaning, LLC will not be held liable for any damages or theft to the client’s home.

32. Policy for Breakage, Damage, and Loss
While cleaning, the chance of breaking or damage exists, albeit rare. Our providers take reasonable precautions when cleaning your house, and all providers carry insurance to cover any damage or breakage they may cause.
We are not responsible for damage caused by regular wear and tear, improper installation of an item in your home, artwork, collectibles, or family artifacts that were not revealed during the booking process.
Artwork, Collectibles, and Family Heirlooms: These objects are expensive and irreplaceable; thus, the client must identify them prior to the start of service. Please specify how you would like your fragile goods to be handled and with what level of care.
Personal property that is damaged or lost must be reported within 24 hours. Always identical replacement is sought, but it is not guaranteed.

33. Before and After Photo Usage Policy
We take pride in our exceptional cleaning services provided by our esteemed partners. To showcase the remarkable transformations achieved by our cleaners, we have a photo usage policy that promotes transparency and celebrates our collaborative efforts.
Our partnered cleaners are authorized to capture before and after photos of the spaces they clean. These photos may be used on our website, blog, and social media platforms to demonstrate our service efficacy and partner professionalism.

Image Selection: Our marketing team will curate the most relevant and representative photos aligning with our branding and messaging.

Client Requests: Client preferences regarding photo usage will be respected.
This policy aims to enhance our online presence, showcase our cleaning partners’ talents, and further build trust and satisfaction with our clients.

34. Non-Solicitation of Cleaning Providers
The Client agrees not to directly engage, hire, or contract with any individual cleaning provider employed by or contracted through Tidy Bear Cleaning, LLC, within Tarrant County and any county contiguous thereto, during the term of services and for twelve (12) months following the termination of services. This restriction is limited to providers who performed services at the Client’s property and applies only to direct, private engagement outside of a booking through the Company. Violation of this provision will result in a training and placement fee of $2,500.00 payable to Tidy Bear Cleaning, LLC, which the Client acknowledges is a reasonable estimate of the Company’s recruitment and training costs. This clause is enforceable under Texas Business and Commerce Code Section 15.50 et seq.

35. Governing Law
Any claim relating to Tidy Bear Cleaning, LLC's web site shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.

36. Binding Arbitration and Attorney’s Fees
If the dispute is not resolved through mediation as set forth in Section 14.3, the Client agrees that any and all remaining disputes, claims, or controversies arising out of or relating to this Agreement, the services provided, or any breach thereof shall be resolved exclusively through binding arbitration conducted in Tarrant County, Texas, in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules then in effect. The Client expressly waives any right to a jury trial or to participate in a class action. In the event that arbitration or any legal proceeding is initiated, the arbitrator or court may award reasonable and necessary attorney’s fees and costs to the prevailing party, consistent with applicable Texas law, including the provisions of the Texas Deceptive Trade Practices–Consumer Protection Act (Tex. Bus. & Com. Code §§ 17.50(c)–(d)). Neither party waives any right to attorney’s fees granted by applicable statute. This provision shall survive the termination of this Agreement.

36. Defamation and Reputational Harm
Nothing in this Agreement restricts, limits, or penalizes the Client’s right to post honest, truthful reviews, ratings, or assessments of Tidy Bear Cleaning, LLC or its services on any platform, including but not limited to Google, Yelp, Facebook, the Better Business Bureau, or social media. The Client retains all intellectual property rights in any review they author. Nothing herein, however, authorizes the Client to make knowingly false statements of material fact about Tidy Bear Cleaning, LLC, its owners, employees, or contractors, that constitute defamation under Texas law, including the Texas Defamation Mitigation Act (Tex. Civ. Prac. & Rem. Code Ch. 73). Tidy Bear Cleaning, LLC reserves all rights to seek legal remedies for statements that are knowingly false and defamatory under applicable Texas law. In any such proceeding, attorney’s fees shall be awarded consistent with applicable law. This provision shall survive the termination of this Agreement.
